General info
ArguStress mnsX monitor continuously monitors its user’s metabolic energy generation and autonomous nerve system and gives real-time feedback about its user’s momentary body status during the workout. For more accurate feedback, mnsX must collects physiological and performance data during the workout and requires predefined parameters. After each workout, mnsX’s user can upload the training record into the ArguStress’ cloud, where the training will be stored, and also goes through a detailed analysis which will adjust the mnsX’s parameters so it will adapt more and more to its user’s metabolic and nerve system and improves the feedback’s accuracy for the next workout.
This Privacy Policy the ways ArguStress Inc. (“ArguStress”, “mnsX”, “we”, ”our” or “us”) collects, handles, and protects every type of information and data that mnsX collects during the workout and its user (“you”) gives us at the mnsX registration and at the mnsX’s settings.
This Privacy Policy applies to every type of information and data mnsX and ArguStress iOS and Android mobile applications collect. This Privacy Policy DOES NOT apply to our websites’ cookies (https://argustress.com, https://argustress-8cd92.web.app) and the personal information that Stripe collects at purchasing an item or subscription. They have separate privacy policies, please see the Cookies Policy and Third-Party Financing below.
By using your mnsX, you agree that we may collect and use every type of information in accordance with this Privacy Policy and as permitted or required by law. If you lend your mnsX to another person and/or you provide another person’s information at registration and at mnsX’s settings, you represent that you have all necessary authority and/or have obtained all necessary consents from such person to do so and enable us to collect and use such person’s every type of information and data as set forth in this Privacy Policy.
For easier reading, in the rest of this document “you” and “your” refer to the person who is using the mnsX monitor.
If you are not comfortable collecting and storing your data as described in Privacy Policy, you must not use mnsX and the ArguStress iOS and Android mobile applications.
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy, and in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you a notification within the iOS/Android mobile application).
If you have concerns or questions, don’t understand, or missing something from the policies please contact us immediately!
Collection of information
To use your new mnsX properly, you must register, activate, it in our system, then set it up.
At registration, we ask you to provide a nickname, birth year, gender, weight, and height. We also ask for your e-mail address, however, we instantly create an unrecoverable code
(E.g.: example@example.com -> 52491), and we store this code. Please check the Communication section for more information.
After registering your mnsX you can set up its parameters such as connecting a heart rate chest strap to your mnsX, setting your heart rate zones’ value, bike power zones’ values, and/or run power zones’ values.
During the workout, mnsX collects your physiological data, heart rate (if you connected an HR sensor), and other performance data, such as power, cadence, speed, distance, and altitude (if you are using a bike computer or smartwatch).
All collected data that mnsX collects during the workout or provided by you through the mobile application is linked to the mnsX monitor, not to its user.
We DO NOT collect and store any personal information such as your first and last name, address, or e-mail address.
We DO NOT collect and store any route or GPS information from your bike computer/smartwatch!
In the ArguStress system, only the mnsX monitors exist, their users are ghosts.
Background Location Data on Android Devices: ArguStress Android mobile application collects location data in the background to perform Bluetooth operations. This is done to ensure that Bluetooth Services will resume smoothly when the app is resumed. Location Data is never used and stored in the ArguStress system (in the mnsX, in our cloud), and never shared with third parties.
Use of Information
During workouts, mnsX uses physiological and performance data to give accurate feedback about its user's momentary body status and stores the data for further analysis and storage.
ArguStress Cloud Analyzer uses the uploaded data to adjust the mnsX’s parameters to adapt more to its user’s metabolic and nervous system and give more accurate feedback. Also, uses the stored training records to improve its analysis performance and accuracy.
Garmin™ Connect IQ™
We have Garmin Connect IQ data fields and applications, which we are using to display the mnsX sensor’s feedback. Garmin Connect IQ data fields and applications record a FIT file during each workout and you can save or discard it at the end of the workout. Our data fields and applications DO NOT save any information that mnsX collected from its user or calculated during the workout.
Securing and storing data
Training records could be found on your mnsX and in our cloud storage if you uploaded them.
mnsX stores 8 hours of training records and can only be read with the iOS/Android mobile application (which requires a registered/activated mnsX). If you want to delete a training record, you must factory reset the mnsX (see more information in the Your choice section) or overwrite it with a new one.
You can list, download and delete stored training records from the cloud using the iOS/Android mobile application. The stored data in the cloud is protected with password authentication.
You are responsible for protecting the confidentiality of your account information and restricting access to your mobile device. You agree to notify us immediately if you suspect or become aware of any unauthorized use of your account.
ArguStress is based in Canada, however, our cloud servers are in Hungary and Canada. You can access our cloud anywhere in the world and only through our iOS/Android mobile application.
We are not using any third-party services to store your mnsX’s training records. When you upload data it is uploaded straight into our cloud and if you download one from the cloud it is downloaded straight from the cloud on your mobile device. The upload and download data are encrypted, however, it is your responsibility always to use a secured internet connection when you upload or download data to/from our cloud. ArguStress is not responsible for your failure to secure your own devices and their access to the Internet or your use of public, unsecured networks.
Data retention
We keep your data for as long as you delete it or factory reset your mnsX, except as otherwise permitted or required by applicable law or regulation.
If there is data you cannot access or correct on your own, please get in touch with us immediately.
Please note that in some cases, ArguStress may not provide access to your data, such as if the denial of access is authorized by law. There are also cases where we may be legally required to refuse access to your data. If ArguStress denies your request for access to, correction, or deletion of your data, we will advise you of the reason for the refusal and will provide the name, title, and contact information of the designated person who can address the refusal.
Your choice
You can update, or delete any personal data such as a nickname, weight, height, birth year, gender, heart rate zones’ value, and bike and/or run power zones’ value in the iOS/Android mobile application.
You can factory reset your mnsX in the iOS/Android mobile application, which is a process. When you start the process your mnsX sensor will be deactivated immediately and you must wait for one of ArguStress's employees to send you an e-mail where she/he will ask for one more confirmation of the factory reset. If you approve it, an ArguStress employee will delete every piece of information in our cloud system, cancel your renewable subscription and delete that Stripe profile too (if that exists). After the full reset, we notify you in an e-mail that the factory reset is done.
If you are a resident of the European Union or California, you have additional rights as described in the separate sections applicable to you below.
Our choice
We may have legitimate reasons to use the information to comply with, any legal or regulatory requirements, as well as to detect and protect ArguStress, its offerings, and other third parties against inappropriate or illegal activity, and to audit compliance with ArguStress’s policies and contractual obligations. (Applicable legal basis under GDPR: legitimate interest, and performance of a contract)
ArguStress may also disclose your information where authorized or required by law, including legitimate business purposes authorized by law. For example, we may disclose your personal information to comply with a subpoena, to assert our rights, in response to a law enforcement body with the lawful authority to obtain the information, pursuant to an investigation into the breach of a law, or to our legal counsel.
We may ask for further data to confirm your identity when you contact us.
GDPR
Under the GDPR, you may be entitled to additional rights, including:
(i) the right to withdraw consent to processing where consent is the basis of processing;
(ii) the right to object to unlawful data processing, under certain conditions;
(iii) the right to erasure of personal information about you, under certain conditions;
(iv) the right to demand that we restrict processing of your Personal Information, under certain conditions, if you believe we have exceeded the legitimate basis for processing, processing is no longer necessary, or believe your personal information is inaccurate;
(v) the right to data portability of personal information concerning you that you provided us in a structured, commonly used, and machine-readable format, under certain conditions;
(vi) the right to object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you, under certain conditions.

Resident of California
If you are a resident of California, you have certain rights and protections under the law regarding processing your information.
Deletion. You can request that we delete personal information about you that we have collected from you.
Information. You can request that, for personal information that we have collected in the preceding 12 months, we disclose, free of charge:
  • The categories of personal information that we have collected about you.
  • The categories of sources from which we collected personal information.
  • The business or commercial purpose for collecting or selling personal information.
  • The categories of third parties with whom we share personal information.
  • The categories of personal information that we sold or disclosed for a business purpose, and for each category identified, the categories of third parties to whom the personal information was sold or disclosed.
Access. You can request a copy of the personal information we have collected about you during the past 12 months. (We DO NOT sell personal information and have not sold it during the past 12 months. We do not have actual knowledge that we sell the personal information of minors under 16 years of age.)
Non-discrimination. You are entitled to exercise the rights described above free from discrimination.
Right to information, access, and deletion. Before we can fulfill the requests for information, access, or deletion noted above, we must verify your identity.
Your authorized agent may make a request on your behalf upon our verification of the agent’s identity and our receipt of a copy of a valid power of attorney given to your authorized agent (e.g. pursuant to California Probate Code Sections 4000-4465). If you have not provided your agent with such a power of attorney, you must provide your agent with written and signed permission to exercise your rights on your behalf, provide the information we request to verify your identity and provide us with confirmation that you have given the authorized agent permission to submit the request.
Children Policy
ArguStress iOS/Android mobile application doesn’t allow registering under 16 years old.
Sharing information
You can give permission to another person who has ArguStress Coach account to inspect your training records. Permission is valid until you cancel it. You should only give permission to that person whom you trust. We are not responsible for what that person does with your data.
We do not sell any data of yours!
We won’t share your data except in response to a request for information if we believe disclosure is in accordance with or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements or if we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property, and safety of ArguStress.
Communication
Because we are not storing your e-mail address, we won’t send any e-mail to you unless you request a password reset or factory reset or if you wrote to us first.
Please be aware of all unexpected e-mail that seems to come from us! If you got one we would appreciate it if you notify us.
We will share every new update on our website and official social media accounts.

Cookies Policy
Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Removing cookies won’t affect our website functionality. Rejecting cookies will affect our website functionality.
When you log in to your account, we create a personal login session and save it in a cookie. The session cookie lifetime is 5 days. When you visit your account again, the website automatically uses the saved cookie to log you in. You can delete this session cookie by logging out from your account or clearing the website’s data in your browser.
Our website is hosted on the Firebase server. Third-Party analytics companies may use cookies and other tracking technologies to perform their services. ArguStress doesn’t collect any information from cookies on purpose. We don’t use, store, or share any information which Firebase might collect from you.
